55If a conservation officer seizes anything other than a vehicle, or an individual, or part or derivative of an individual, of a listed wildlife species, the conservation officer shall return it to the owner or person in possession at the time of the seizure
(a)
without delay, if the person is not charged with an offence under this Act or the regulations, or
(b)
within 30 days after the final disposition of the charge,
(i)
if the person has been charged with an offence under this Act or the regulations and no conviction results from that charge, or
(ii)
if the person has been charged with an offence under this Act or the regulations and is convicted but the judge does not order the forfeiture of the thing seized.
